Terms of Service

Purpose

These terms govern access to and use of the Viridia service (plant identification, garden tracking, coaching, connection with professional gardeners, community features). By creating an account, you accept these terms as well as our privacy policy.

Service publisher

Viridia is published by WS VENTURES, a French simplified joint-stock company (SAS) with a share capital of €1,000, registered under SIREN 107 479 388 (head office SIRET 107 479 388 000 12, intra-community VAT FR88107479388), with its registered office at 150 chemin de Figournas, 06480 La Colle-sur-Loup, France. Publication director: Elie Schouver. Contact: contact@viridia.pro. The service is hosted by OVH SAS, 2 rue Kellermann, 59100 Roubaix, France.

Access to the service

Registration is open to anyone aged 15 or over (the age of digital consent in France). You are responsible for keeping your password confidential and, where applicable, your authentication methods (2FA code, passkey).

This condition is self-declared: we do not ask for any proof of age.

⚠️ Important limitation: plant identification is an aid, not a guarantee

The plant identification provided by Viridia relies on artificial intelligence services and can be wrong. Never eat a plant, fruit or mushroom on the sole basis of an identification made by the app — if in any doubt about whether a plant is edible or toxic, always consult a qualified expert (pharmacist, local mycology/botany society) before consuming anything. Viridia declines all liability in the event of misuse of this kind.

Recipe suggestions only cover species our catalogue identifies as edible and free of any toxicity note, and only concern the part of the plant that is usually eaten. This filtering reduces the risk of error; it does not replace your own verification, which remains essential before eating anything.

Treatments and garden products

The health diagnosis may propose a treatment plan naming generic products (for example diluted black soap or Bordeaux mixture), with an indicative dose and frequency. These indications are general gardening information, never a prescription. The label of the product you use always overrides our indications, in particular for the approved dose, the pre-harvest interval and protective equipment. Only use products approved for home garden use, never treat during full bloom or near beehives, and keep children and animals away from treated surfaces. For a valuable plant, a crop intended for consumption, or the slightest doubt, call on a qualified professional.

Artificial intelligence assistance

Several features (identification, health diagnosis, the Rootsy assistant, suggestions and recipes) rely on artificial intelligence systems. When you talk to Rootsy, you are interacting with an automated system, not with a person. These systems produce plausible but not guaranteed answers, and they can be wrong: treat them as decision support, not as expert advice.

Content you publish

You remain the owner of the photos and text you publish. By publishing them on a publicly visible page (garden showcase, forum, pro page), you authorise us to host and display them as part of the service. You warrant that you hold the necessary rights to any content you publish, and you undertake to respect the rights of third parties (image rights, intellectual property) and not to publish any unlawful, offensive or misleading content.

Photos submitted for identification. You remain the owner of the photos you submit for identification. When you confirm an identification, you grant us, for the lifetime of your account and worldwide, a non-exclusive, royalty-free licence to reproduce and analyse the part of the photo showing the plant, for the sole purpose of improving plant recognition by Viridia. This licence does not allow us to publish these photos, transfer them, or use them for advertising. You can end it at any time from your settings; the photos concerned are then removed.

Premium account — offers and prices

Some features (health diagnosis, garden video scan, Rootsy assistant, extended identification quotas, additional gardens…) are reserved for Premium accounts. Three offers are available: the monthly Premium subscription (French reference price: €4.99 incl. tax per month, automatically renewed), the yearly Premium subscription (French reference price: €54.99 incl. tax per year, automatically renewed, offered in the mobile apps) and the Founder offer (French reference price: €99 incl. tax, one-time payment, giving access to Premium features for the entire lifetime of the service, limited to the first 500 subscribers). The monthly quotas included in Premium depend on your country of residence and are shown in the app. Prices too are adapted by country; the price displayed at the time of purchase, in your currency and on the channel used, is authoritative. It includes all taxes, the applicable VAT depending on your country of residence.

Purchase channels and management

Purchases are made through the channel you use: on the website via our payment provider Stripe, or in the mobile apps via the App Store (Apple) or Google Play. Your subscription is managed and cancelled through the purchase channel: the Stripe billing portal from your web account, or the subscription settings of the App Store / Google Play. Prices and terms may differ slightly between channels (platform fees and rules).

Renewal, cancellation and refunds

The monthly subscription renews automatically at each term. You may cancel at any time; cancellation takes effect at the end of the current period, already paid for, which is not refunded pro rata. Premium access ends at that term. For purchases made through the App Store or Google Play, refund requests are handled by Apple or Google under their own policies.

The Founder offer is a one-off, non-renewable payment; “lifetime” means the operating life of the Viridia service. Should the service be permanently discontinued, we undertake to inform users with at least three months' notice and to refund the one-off payment according to the following scale, counted from the date of purchase:

• discontinued less than 12 months after purchase: 100 % refunded;
• discontinued between 12 and 24 months: 50 % refunded;
• discontinued between 24 and 36 months: 25 % refunded;
• discontinued beyond 36 months: no refund.

This scale does not override any mandatory legal provisions more favourable to you.

Right of withdrawal

In accordance with the law applicable to digital content and services, by ticking the box provided at the time of purchase, you request immediate performance of the service and expressly acknowledge losing your 14-day right of withdrawal. That box is never pre-ticked and the purchase cannot proceed without it; the date and the exact wording you consented to are retained. Your statutory rights (guarantees, refunds provided for by law) remain unchanged.

Connecting with professionals

Viridia acts as an intermediary. When a service is agreed with a professional gardener or landscaper (booking, quote request), the contract is concluded between you and that professional: we are not a party to it and we guarantee neither its performance, nor its outcome, nor the qualifications the professional declares.

The ranking of the professionals shown is based on geographical proximity, how complete the listing is, and recent activity on Viridia. To date, no payment alters this ranking; should that change, it would be stated here. Some listings display an aggregate rating coming from Google: it is reproduced as is, we do not verify it and we do not moderate it. Reviews published on Viridia come from registered accounts; we do not verify that a review corresponds to a service actually performed.

Creator Programme

Content creators invited to our Creator Programme are bound by a separate contract, shown before signature and then archived. Any payments are made by our payment provider, after identity verification by that provider. A creator acts as an independent partner: they are neither an employee nor an agent of WS VENTURES, and it is for them to declare the sums received and to meet their tax and social security obligations. In accordance with Article 242 bis of the French General Tax Code, we send them an annual summary of the sums paid to them.

Community conduct and moderation

Community spaces (forum, comments, connections with professionals) must be used respectfully. You can report content from the interface. Our moderation combines those reports, human review and automated filters; we may also act on our own initiative. When content you have published is removed or an account is restricted, we state the reason, and you may contest the decision by writing to contact@viridia.pro — the review is carried out by a person. We reserve the right to remove any content contrary to these terms and to suspend an account in the event of repeated abuse.

Termination

You can delete your account at any time, without justification, from Settings → My data. We may suspend or terminate your access in the event of a serious breach of these terms.

Liability

The service is provided "as is". We use reasonable means to ensure its availability and reliability, without any guarantee of result: interruptions may occur for maintenance, or through the failure of a host or of a third-party service we depend on. Gardening and coaching advice provided by the service is indicative and does not replace a professional's opinion for any decision with serious consequences (safety, health — see the limits above on identification and treatments). No limitation in these terms applies to personal injury or to cases where the law prohibits it.

Changes to these terms

We may amend these terms, in particular to keep pace with the service or with regulation. The applicable version is the one published on this page, dated at the top. Any substantial change is signalled to you in the application; continuing to use the service after that notice constitutes acknowledgement. If a change were to impose a new obligation on you, your express agreement would be sought.

Disputes

These terms are governed by French law. Any dispute falls to the courts having jurisdiction over the registered office of WS VENTURES (Alpes-Maritimes), subject to the protective provisions applicable to consumers. Before any action, write to us at contact@viridia.pro: the vast majority of disagreements are settled that way. In accordance with Articles L.612-1 et seq. of the French Consumer Code, consumers may use a consumer mediator free of charge. The mediator's appointment is under way; their details will be published on this page once they take office.
